Well, one of these arguments is correct, but not both at the same time.
If it's a non-free version, then you bought it - so it's free of ads and possible spyware.
If it comes with ads (and possible spyware), it's free.
The Opera guys emphasize in their privacy statement that they don't spy you out etc., but I understand your skepticism - and share it, in fact.
Let's say FireFox is the best free browser I know, whereas Opera is my favourite browser.
